  4. The Cooperative Non-Violent Public license is a freedom-respecting sharealike
  5. license for both the author of a work as well as those subject to a work.
  6. It aims to protect the basic rights of human beings from exploitation,
  7. the earth from plunder, and the equal treatment of the workers involved in the
  8. creation of the work. It aims to ensure a copyrighted work is forever
  9. available for public use, modification, and redistribution under the same
  10. terms so long as the work is not used for harm. For more information about

  14. THE WORK (AS DEFINED BELOW) IS PROVIDED UNDER THE TERMS OF THIS
  15. COOPERATIVE NON-VIOLENT PUBLIC LICENSE v4 ("LICENSE"). THE WORK IS
  16. PROTECTED BY COPYRIGHT AND ALL OTHER APPLICABLE LAWS. ANY USE OF THE
  17. WORK OTHER THAN AS AUTHORIZED UNDER THIS LICENSE OR COPYRIGHT LAW IS
  18. PROHIBITED. BY EXERCISING ANY RIGHTS TO THE WORK PROVIDED IN THIS
  19. LICENSE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE.
  20. TO THE EXTENT THIS LICENSE MAY BE CONSIDERED TO BE A CONTRACT,

  24. 1. DEFINITIONS
  25. a. "Act of War" means any action of one country against any group
  26. either with an intention to provoke a conflict or an action that
  27. occurs during a declared war or during armed conflict between
  28. military forces of any origin. This includes but is not limited
  29. to enforcing sanctions or sieges, supplying armed forces,
  30. or profiting from the manufacture of tools or weaponry used in
  31. military conflict.
  32. b. "Adaptation" means a work based upon the Work, or upon the
  33. Work and other pre-existing works, such as a translation,
  34. adaptation, derivative work, arrangement of music or other
  35. alterations of a literary or artistic work, or phonogram or
  36. performance and includes cinematographic adaptations or any
  37. other form in which the Work may be recast, transformed, or
  38. adapted including in any form recognizably derived from the
  39. original, except that a work that constitutes a Collection will
  40. not be considered an Adaptation for the purpose of this License.
  41. For the avoidance of doubt, where the Work is a musical work,
  42. performance or phonogram, the synchronization of the Work in
  43. timed-relation with a moving image ("synching") will be
  44. considered an Adaptation for the purpose of this License.
  45. c. "Bodily Harm" means any physical hurt or injury to a person that
  46. interferes with the health or comfort of the person and that is more
  47. more than merely transient or trifling in nature.
  48. d. "Collection" means a collection of literary or artistic
  49. works, such as encyclopedias and anthologies, or performances,
  50. phonograms or broadcasts, or other works or subject matter other
  51. than works listed in Section 1(i) below, which, by reason of the
  52. selection and arrangement of their contents, constitute
  53. intellectual creations, in which the Work is included in its
  54. entirety in unmodified form along with one or more other
  55. contributions, each constituting separate and independent works
  56. in themselves, which together are assembled into a collective
  57. whole. A work that constitutes a Collection will not be
  58. considered an Adaptation (as defined above) for the purposes of
  59. this License.
  60. e. "Distribute" means to make available to the public the
  61. original and copies of the Work or Adaptation, as appropriate,
  62. through sale, gift or any other transfer of possession or
  63. ownership.
  64. f. "Incarceration" means confinement in a jail, prison, or any
  65. other place where individuals of any kind are held against
  66. either their will or the will of their legal guardians.
  67. g. "Licensor" means the individual, individuals, entity or
  68. entities that offer(s) the Work under the terms of this License.
  69. h. "Original Author" means, in the case of a literary or
  70. artistic work, the individual, individuals, entity or entities
  71. who created the Work or if no individual or entity can be
  72. identified, the publisher; and in addition (i) in the case of a
  73. performance the actors, singers, musicians, dancers, and other
  74. persons who act, sing, deliver, declaim, play in, interpret or
  75. otherwise perform literary or artistic works or expressions of
  76. folklore; (ii) in the case of a phonogram the producer being the
  77. person or legal entity who first fixes the sounds of a
  78. performance or other sounds; and, (iii) in the case of
  79. broadcasts, the organization that transmits the broadcast.
  80. i. "Work" means the literary and/or artistic work offered under
  81. the terms of this License including without limitation any
  82. production in the literary, scientific and artistic domain,
  83. whatever may be the mode or form of its expression including
  84. digital form, such as a book, pamphlet and other writing; a
  85. lecture, address, sermon or other work of the same nature; a
  86. dramatic or dramatico-musical work; a choreographic work or
  87. entertainment in dumb show; a musical composition with or
  88. without words; a cinematographic work to which are assimilated
  89. works expressed by a process analogous to cinematography; a work
  90. of drawing, painting, architecture, sculpture, engraving or
  91. lithography; a photographic work to which are assimilated works
  92. expressed by a process analogous to photography; a work of
  93. applied art; an illustration, map, plan, sketch or
  94. three-dimensional work relative to geography, topography,
  95. architecture or science; a performance; a broadcast; a
  96. phonogram; a compilation of data to the extent it is protected
  97. as a copyrightable work; or a work performed by a variety or
  98. circus performer to the extent it is not otherwise considered a
  99. literary or artistic work.
  100. j. "You" means an individual or entity exercising rights under
  101. this License who has not previously violated the terms of this
  102. License with respect to the Work, or who has received express
  103. permission from the Licensor to exercise rights under this
  104. License despite a previous violation.
  105. k. "Publicly Perform" means to perform public recitations of the
  106. Work and to communicate to the public those public recitations,
  107. by any means or process, including by wire or wireless means or
  108. public digital performances; to make available to the public
  109. Works in such a way that members of the public may access these
  110. Works from a place and at a place individually chosen by them;
  111. to perform the Work to the public by any means or process and
  112. the communication to the public of the performances of the Work,
  113. including by public digital performance; to broadcast and
  114. rebroadcast the Work by any means including signs, sounds or
  115. images.
  116. l. "Reproduce" means to make copies of the Work by any means
  117. including without limitation by sound or visual recordings and
  118. the right of fixation and reproducing fixations of the Work,
  119. including storage of a protected performance or phonogram in
  120. digital form or other electronic medium.
  121. m. "Software" means any digital Work which, through use of a
  122. third-party piece of Software or through the direct usage of
  123. itself on a computer system, the memory of the computer is
  124. modified dynamically or semi-dynamically. "Software",
  125. secondly, processes or interprets information.
  126. n. "Source Code" means the human-readable form of Software
  127. through which the Original Author and/or Distributor originally
  128. created, derived, and/or modified it.
  129. o. "Surveilling" means the use of the Work to either
  130. overtly or covertly observe and record persons and or their
  131. activities.
  132. p. "Web Service" means the use of a piece of Software to
  133. interpret or modify information that is subsequently and directly
  134. served to users over the Internet.
  135. q. "Discriminate" means the use of a work to differentiate between
  136. humans in a such a way which prioritizes some above others on the
  137. basis of percieved membership within certain groups.
  138. r. "Hate Speech" means communication or any form
  139. of expression which is solely for the purpose of expressing hatred
  140. for some group or advocating a form of Discrimination
  141. (to Discriminate per definition in (q)) between humans.
  142. 2. FAIR DEALING RIGHTS
  143. Nothing in this License is intended to reduce, limit, or restrict any
  144. uses free from copyright or rights arising from limitations or
  145. exceptions that are provided for in connection with the copyright
  146. protection under copyright law or other applicable laws.
  147. 3. LICENSE GRANT
  148. Subject to the terms and conditions of this License, Licensor hereby
  149. grants You a worldwide, royalty-free, non-exclusive, perpetual (for the
  150. duration of the applicable copyright) license to exercise the rights in
  151. the Work as stated below:
  152. a. to Reproduce the Work, to incorporate the Work into one or
  153. more Collections, and to Reproduce the Work as incorporated in
  154. the Collections;
  155. b. to create and Reproduce Adaptations provided that any such
  156. Adaptation, including any translation in any medium, takes
  157. reasonable steps to clearly label, demarcate or otherwise
  158. identify that changes were made to the original Work. For
  159. example, a translation could be marked "The original work was
  160. translated from English to Spanish," or a modification could
  161. indicate "The original work has been modified.";
  162. c. to Distribute and Publicly Perform the Work including as
  163. incorporated in Collections; and,
  164. d. to Distribute and Publicly Perform Adaptations. The above
  165. rights may be exercised in all media and formats whether now
  166. known or hereafter devised. The above rights include the right
  167. to make such modifications as are technically necessary to
  168. exercise the rights in other media and formats. Subject to
  169. Section 8(g), all rights not expressly granted by Licensor are
  170. hereby reserved, including but not limited to the rights set
  171. forth in Section 4(i).
  172. 4. RESTRICTIONS
  173. The license granted in Section 3 above is expressly made subject to and
  174. limited by the following restrictions:
  175. a. You may Distribute or Publicly Perform the Work only under
  176. the terms of this License. You must include a copy of, or the
  177. Uniform Resource Identifier (URI) for, this License with every
  178. copy of the Work You Distribute or Publicly Perform. You may not
  179. offer or impose any terms on the Work that restrict the terms of
  180. this License or the ability of the recipient of the Work to
  181. exercise the rights granted to that recipient under the terms of
  182. the License. You may not sublicense the Work. You must keep
  183. intact all notices that refer to this License and to the
  184. disclaimer of warranties with every copy of the Work You

  203. exchange of the Work for other copyrighted works by means of
  204. digital file-sharing or otherwise shall not be considered to be
  205. intended for or directed toward commercial advantage or private
  206. monetary compensation, provided there is no payment of any
  207. monetary compensation in connection with the exchange of
  208. copyrighted works.
  209. c. If the Work meets the definition of Software, You may exercise
  210. the rights granted in Section 3 only if You provide a copy of the
  211. corresponding Source Code from which the Work was derived in digital
  212. form, or You provide a URI for the corresponding Source Code of
  213. the Work, to any recipients upon request.
  214. d. If the Work is used as or for a Web Service, You may exercise
  215. the rights granted in Section 3 only if You provide a copy of the
  216. corresponding Source Code from which the Work was derived in digital
  217. form, or You provide a URI for the corresponding Source Code to the
  218. Work, to any recipients of the data served or modified by the Web
  219. Service.
  220. e. You may exercise the rights granted in Section 3 for
  221. commercial purposes only if you satisfy any of the following:
  222. i. You are a worker-owned business or worker-owned
  223. collective; and
  224. ii. after tax, all financial gain, surplus, profits and
  225. benefits produced by the business or collective are
  226. distributed among the worker-owners unless a set amount
  227. is to be allocated towards community projects as decided
  228. by a previously-established consensus agreement between the
  229. worker-owners where all worker-owners agreed
  230. iii. You are not using such rights on behalf of a business
  231. other than those specified in 4(e.i) and elaborated upon in
  232. 4(e.ii), nor are using such rights as a proxy on behalf of a
  233. business with the intent to circumvent the aforementioned
  234. restrictions on such a business.
  235. f. Any use by a business that is privately owned and managed,
  236. and that seeks to generate profit from the labor of employees
  237. paid by salary or other wages, is not permitted under this
  238. license.
  239. g. You may exercise the rights granted in Section 3 for
  240. any purposes only if:
  241. i. You do not use the Work for the purpose of inflicting
  242. Bodily Harm on human beings (subject to criminal
  243. prosecution or otherwise) outside of providing medical aid.
  244. ii.You do not use the Work for the purpose of Surveilling
  245. or tracking individuals for financial gain.
  246. iii. You do not use the Work in an Act of War.
  247. iv. You do not use the Work for the purpose of supporting
  248. or profiting from an Act of War.
  249. v. You do not use the Work for the purpose of Incarceration.
  250. vi. You do not use the Work for the purpose of extracting
  251. oil, gas, or coal.
  252. vii. You do not use the Work for the purpose of
  253. expediting, coordinating, or facilitating paid work
  254. undertaken by individuals under the age of 12 years.
  255. viii. You do not use the Work to either Discriminate or
  256. spread Hate Speech on the basis of sex, sexual orientation,
  257. gender identity, race, age, disability, color, national origin,
  258. religion, or lower economic status.
  259. h. If You Distribute, or Publicly Perform the Work or any
  260. Adaptations or Collections, You must, unless a request has been
  261. made pursuant to Section 4(a), keep intact all copyright notices
  262. for the Work and provide, reasonable to the medium or means You
  263. are utilizing: (i) the name of the Original Author (or
  264. pseudonym, if applicable) if supplied, and/or if the Original
  265. Author and/or Licensor designate another party or parties (e.g.,
  266. a sponsor institute, publishing entity, journal) for attribution
  267. ("Attribution Parties") in Licensor!s copyright notice, terms of
  268. service or by other reasonable means, the name of such party or
  269. parties; (ii) the title of the Work if supplied; (iii) to the
  270. extent reasonably practicable, the URI, if any, that Licensor
  271. specifies to be associated with the Work, unless such URI does
  272. not refer to the copyright notice or licensing information for
  273. the Work; and, (iv) consistent with Section 3(b), in the case of
  274. an Adaptation, a credit identifying the use of the Work in the
  275. Adaptation (e.g., "French translation of the Work by Original
  276. Author," or "Screenplay based on original Work by Original

  283. other contributing authors. For the avoidance of doubt, You may
  284. only use the credit required by this Section for the purpose of
  285. attribution in the manner set out above and, by exercising Your
  286. rights under this License, You may not implicitly or explicitly
  287. assert or imply any connection with, sponsorship or endorsement
  288. by the Original Author, Licensor and/or Attribution Parties, as

  292. i. For the avoidance of doubt:
  293. i. Non-waivable Compulsory License Schemes. In those
  294. jurisdictions in which the right to collect royalties
  295. through any statutory or compulsory licensing scheme
  296. cannot be waived, the Licensor reserves the exclusive
  297. right to collect such royalties for any exercise by You of
  298. the rights granted under this License;
  299. ii. Waivable Compulsory License Schemes. In those
  300. jurisdictions in which the right to collect royalties
  301. through any statutory or compulsory licensing scheme can
  302. be waived, the Licensor reserves the exclusive right to
  303. collect such royalties for any exercise by You of the
  304. rights granted under this License if Your exercise of such
  305. rights is for a purpose or use which is otherwise than
  306. noncommercial as permitted under Section 4(b) and

  343. ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW
  344. THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO

  346. 6. LIMITATION ON LIABILITY
  347. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
  348. LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
  349. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF
  350. THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED
  351. OF THE POSSIBILITY OF SUCH DAMAGES.
  352. 7. TERMINATION
  353. a. This License and the rights granted hereunder will terminate
  354. automatically upon any breach by You of the terms of this
  355. License. Individuals or entities who have received Adaptations
  356. or Collections from You under this License, however, will not
  357. have their licenses terminated provided such individuals or
  358. entities remain in full compliance with those licenses. Sections
  359. 1, 2, 5, 6, 7, and 8 will survive any termination of this
  360. License.
  361. b. Subject to the above terms and conditions, the license
  362. granted here is perpetual (for the duration of the applicable
  363. copyright in the Work). Notwithstanding the above, Licensor
  364. reserves the right to release the Work under different license
  365. terms or to stop distributing the Work at any time; provided,
  366. however that any such election will not serve to withdraw this
  367. License (or any other license that has been, or is required to
  368. be, granted under the terms of this License), and this License
  369. will continue in full force and effect unless terminated as
  370. stated above.
  371. 8. REVISED LICENSE VERSIONS
  372. a. This License may receive future revisions in the original

  374. Each version of This License has an incrementing version number.
  375. b. Unless otherwise specified like in Section 8(c) The Licensor
  376. has only granted this current version of This License for The Work.
  377. In this case future revisions do not apply.
  378. c. The Licensor may specify that the latest available
  379. revision of This License be used for The Work by either explicitly
  380. writing so or by suffixing the License URI with a "+" symbol.
  381. d. The Licensor may specify that The Work is also available
  382. under the terms of This License's current revision as well
  383. as specific future revisions. The Licensor may do this by
  384. writing it explicitly or suffixing the License URI with any
  385. additional version numbers each separated by a comma.
  386. 9. MISCELLANEOUS
  387. a. Each time You Distribute or Publicly Perform the Work or a
  388. Collection, the Licensor offers to the recipient a license to
  389. the Work on the same terms and conditions as the license granted

  391. b. Each time You Distribute or Publicly Perform an Adaptation,
  392. Licensor offers to the recipient a license to the original Work

  421. h. The rights granted under, and the subject matter referenced,
  422. in this License were drafted utilizing the terminology of the
  423. Berne Convention for the Protection of Literary and Artistic

  425. 1961, the WIPO Copyright Treaty of 1996, the WIPO Performances
  426. and Phonograms Treaty of 1996 and the Universal Copyright

  428. subject matter take effect in the relevant jurisdiction in which
  429. the License terms are sought to be enforced according to the
  430. corresponding provisions of the implementation of those treaty
  431. provisions in the applicable national law. If the standard suite
  432. of rights granted under applicable copyright law includes
  433. additional rights not granted under this License, such
  434. additional rights are deemed to be included in the License; this
  435. License is not intended to restrict the license of any rights
  436. under applicable law.
